Program Terms and Conditions

Welcome to the Domonique Bertolucci Coaching Academy – Professional Coach Training Program. By enrolling in the Program, you (“Student”) agree to the following terms and conditions (“Agreement”). These terms govern your participation in the Program and outline the rights and responsibilities of both the Student and the Provider (“Domonique Bertolucci Coaching Academy”). Please read carefully.


1. Program Details

The Program includes live classes, access to a membership site, and recorded sessions. Although all sessions are recorded for your convenience, you are encouraged to attend live classes whenever possible.


2. Program Duration

The core content of the Domonique Bertolucci Coaching Academy – Professional Coach Training Program is delivered over a nine-month period. Following this, you will have an additional three months of support to complete any outstanding peer-to-peer coaching sessions and prepare for certification. Certification applications must be submitted within 12 months from your start date. If necessary, you may apply for an extension in accordance with the extension terms outlined below.


3. Payment Amount and Terms

The total cost of the Program is [Insert Payment Amount].

You may select one of the following payment options:

  • Pay in Full: The full payment must be made before the Program commences.
  • Installment Plan: Payments will be made in 12 installments, according to an agreed-upon schedule.

Late Payment: If your payment is more than 30 days overdue, a late fee of  $250 will be applied. We reserve the right to suspend your access to the Program if payments are not made in a timely manner.


4. Attendance and Missed Classes

To complete your certification, you are required to:

  • Attend at least 75% of the live classes.
  • Complete 100% of the coaching supervision and peer-to-peer coaching sessions.

If you miss more than 25% of live classes, you may apply to attend catch-up sessions in the next cohort, which may be subject to additional fees. Additional coaching supervision can also be arranged for a fee.


5. Program Extension

You must submit your certification application within 12 months of your start date. Extensions may be granted under the following conditions:

  • Up to 28 Days: No fee applies.
  • Beyond 28 Days: A $250 extension fee will apply.
  • Beyond 90 Days: Extension requests will be evaluated on a case-by-case basis.

6. Certification Process

Upon successful completion of the Program, you will be eligible to apply for certification. The certification process includes:

  • Submitting a self-study portfolio.
  • Completing a special interest project.
  • Writing a reflective essay.
  • Passing a practical coaching skills assessment.

After completing the requirements, you will receive dual certifications as a Certified Intention Method Practitioner and Certified Professional Coach, allowing you to use the designation Certified Intention Method™ Coach.


7. ICF Accreditation

Our Program curriculum fulfills 100% of the teaching hours required for ICF accreditation at the PCC level. Students may apply for ICF ACC or PCC credentials through the ICF Portfolio Path. Please note that additional requirements, such as documented coaching hours, mentor coaching, and fees, must be met to achieve ICF accreditation. Our Accreditation Concierge is available to guide you through this process.


8. Withdrawal and Refund Policy

  • General Withdrawal: If you withdraw from the Program at least 90 days before the start date, you will receive a refund minus a $950 administration fee. Withdrawals made within 90 days of the Program start date or during the Program are not eligible for a refund.
  • Early Enrollment Offers: If you enroll under an ‘Early Enrollment Offer,’ or ‘Early Enrollment Discount’ you waive your right to the 90-day refund window, regardless of whether or not you use the early enrollment content.

9. Deferral

If you are unable to complete the Program with your current cohort, you may apply for a transfer to a future intake, subject to availability and capacity. A transfer fee of $750 will apply.


10. Termination

We reserve the right to terminate your enrollment if you fail to meet the attendance or payment requirements, or if you breach any other material term of this Agreement. Termination due to non-compliance will not entitle you to a refund.


11. Student Privacy

We respect your privacy and ask that you respect the privacy of fellow students. Sharing personal information, recordings, or insights from the Program without consent is prohibited.


12. Non-Advice

The coaching you receive throughout the Program from Domonique, program trainers, coaches, and peers does not constitute professional advice. It is not a substitute for professional services in areas such as financial, medical, psychological, or legal matters. You are responsible for your own decisions and actions during and after the Program.


13. Disclaimer

  • No Offer of Employment: Enrolling in the Program does not guarantee employment. While we may recruit from the Program, this is not guaranteed.
  • Earnings Disclaimer: We make no guarantees regarding your income or success after completing the Program. Your results will depend on your efforts, skills, and circumstances. We do not guarantee that you will earn any specific amount of revenue.

14. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your participation in the Program. This includes but is not limited to personal injury, loss of revenue, or business interruption. Our total liability will not exceed the amount you paid for the Program.


15. Media Release

By enrolling in the Program, you grant us permission to use any photographs, videos, or testimonials taken during the Program for promotional purposes. You waive any right to compensation or ownership of the media. This release applies to all forms of media now known or developed in the future, in perpetuity.


16. Intellectual Property

All content provided in the Program is the intellectual property of Domonique Bertolucci and/or the Domonique Bertolucci Company. You are not permitted to teach or distribute the materials without written permission. You may reproduce materials for personal use only, with proper attribution.


17. Affiliate and Referral Fees

If you refer new students to the Program, you may be eligible for referral or affiliate fees as part of specific referral schemes, as defined by us.


18. Diversity and Inclusion

The Program is committed to diversity and inclusion and welcomes individuals of all ages, genders, sexual orientations, races, ethnicities, and religions. We do not tolerate discrimination or harassment of any kind.


19. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. By enrolling in the Program, you agree that any disputes will be resolved in the courts of New South Wales. You waive any rights to bring claims in courts outside of New South Wales.


20. Jurisdiction and Forum Selection 

You expressly agree that any disputes, claims, or causes of action arising out of or related to this Agreement will be governed by the laws of New South Wales, Australia, and exclusively resolved in the courts of New South Wales. By enrolling in the Program, you waive any rights to bring claims in the courts of any jurisdiction outside of New South Wales.


21. Class Action Waiver

You agree to bring any disputes or claims on an individual basis and not as part of a class, consolidated, or representative action. You waive your right to participate in class action lawsuits or class-wide arbitration, including claims arising in the United States.


22. Dispute Resolution / Arbitration 

You agree that any dispute, controversy, or claim arising out of or related to this Agreement will be resolved exclusively by binding arbitration in New South Wales, Australia, under the rules of the Australian Centre for International Commercial Arbitration (ACICA). You agree to waive any objections based on jurisdiction, venue, or inconvenient forum. The decision of the arbitrator will be final and binding on both parties.


23. Force Majeure

We are not responsible for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, wars, strikes, or government actions.


24. Severability

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full effect.


25. Entire Agreement

This Agreement constitutes the entire agreement between you and Domonique Bertolucci Company regarding the Program. Any modifications to this Agreement must be made in writing and signed by both parties.
